 Comprehensive Environmental Response, Compensation, and Liability Act

Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), commonly known as Superfund, was enacted by Congress on December 11, 1980. This law created a tax on the chemical and petroleum industries and provided broad Federal authority to respond directly to releases or threatened releases of hazardous substances that may endanger public health or the environment.

 Defense Environmental Restoration Program

Over the last 20 years, the Defense Environmental Restoration Program (DERP) has evolved into a mature program addressing environmental restoration activities at its active installations, base realignment and closure (BRAC) installations, and formerly used defense sites (FUDS).

 Formerly Used Defense Sites (FUDS) Program

The Formerly Used Defense Sites (FUDS) program was officially established in December 1983, when the FY84 Defense Appropriations Act required that DoD establish a program to manage environmental cleanup at properties formerly controlled by DoD. In 1985, the Army became the executive agent in charge of executing the FUDS program, with the U.S. Army Corps of Engineers assuming the primary management role.

 Military Munitions Response Program

DoD established the management structure and initial program requirements for the Military Munitions Response Program (MMRP) in the September 2001 Management Guidance for the Defense Environmental Restoration Program. DoD modeled the MMRP after its Installation Restoration Program -- the program in which environmental restoration activities are conducted -- allowing it to apply lessons learned from decades of experience under that program.
